§ 8 Withdrawal from the contract

1.     [Deadline for withdrawal]  A consumer who has concluded a distance or off-premises contract may withdraw from it within 14 days without giving any reason. (For transport costs, see point 7) 
2.     [Current period]  The deadline for withdrawal from the contract begins:
1) for a contract under which the entrepreneur delivers an item and is obliged to transfer ownership thereof – from the moment the consumer or a third party indicated by the consumer, other than the carrier, takes possession of the item, and in the case of a contract which:
a) covers many items that are delivered separately, in batches or in parts – from the moment the last item, batch or part is taken into possession, b) involves regular delivery of items for a specified period of time – from the moment the first item is taken into possession; 2) for other contracts – from the date of conclusion of the contract.
3.     [Form of withdrawal]  The consumer may withdraw from the contract by submitting to the entrepreneur a declaration of withdrawal, which constitutes an annex to these regulations. To meet the deadline, it is sufficient to send the declaration before its expiry. 
4. If the entrepreneur provides the option to submit a declaration of withdrawal from the contract electronically, the consumer may also withdraw from the contract:
1) using the withdrawal form template constituting Annex 2 to the Act;
2) by submitting the declaration on the entrepreneur's website.
The entrepreneur is obliged to immediately send the consumer, on a durable medium, confirmation of receipt of the consumer's declaration of withdrawal from the contract. 
5.     [Refund]  The entrepreneur is obliged to immediately, no later than 14 days from the date of receipt of the consumer's declaration of withdrawal from the contract, refund all payments made by the consumer, including the costs of delivery. The entrepreneur shall refund the payments using the same method of payment that the consumer used, unless the consumer has expressly agreed to a different method of refund that does not incur any costs for the consumer. If the entrepreneur has not offered to collect the goods from the consumer, the entrepreneur may withhold the refund of payments received from the consumer until the goods are received back or the consumer provides proof of sending back the goods, whichever occurs first. If the consumer has chosen a delivery method other than the least expensive standard delivery method offered by the entrepreneur, the entrepreneur is not obliged to reimburse the consumer for any additional costs incurred. 
6.     [Limitations on the right of withdrawal] The right to withdraw from a contract concluded away from business premises or at a distance does not apply to the consumer in relation to contracts:
1) for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the provision that after the entrepreneur has fulfilled the service, the consumer will lose the right to withdraw from the contract;
2) in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires;
3) in which the subject of the provision is a non-prefabricated item, manufactured according to the consumer’s specification or intended to meet their individual needs;
4) in which the subject of the provision is an item that spoils quickly or has a short shelf life;
5) in which the subject of the provision is an item delivered in a sealed package that cannot be returned after opening the package for health protection or hygiene reasons if the packaging was opened after delivery;
6) where the subject of the performance are things which after delivery, due to their nature, are inseparably combined with other things;
7) where the subject of the performance are alcoholic beverages, the price of which was agreed upon at the conclusion of the sales contract, the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the entrepreneur has no control;
8) where the consumer has expressly requested the entrepreneur to come to him for urgent repair or maintenance; if the entrepreneur provides additional services other than those requested by the consumer, or delivers items other than spare parts necessary to perform the repair or maintenance, the consumer has the right to withdraw from the contract in respect of additional services or items;
9) where the subject of the performance are audio or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery;
10) for the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement;
11) concluded by way of public auction;
12) for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract specifies the day or period of service provision;
13) for the supply of digital content that is not stored on a tangible medium, if the performance of the service began with the consumer's express consent before the expiry of the withdrawal period and after the trader informed them of the loss of the right of withdrawal.
7. If the consumer exercises the right of withdrawal, the consumer will bear the direct cost of returning the Product. Please include a declaration of withdrawal (unless previously provided) and the account number to which the store should refund the payment with the return shipment.
